These Terms and Conditions (the “Terms”) form a legally binding agreement between you and Wyoming Applied Kinetics (“Wyoming Applied Kinetics,” “we,” “us,” or “our”). They govern your use of wyomingappliedkinetics.com and related pages (the “Site”) and your purchase of any rifle, part, build, repair, re-rivet, or other product or service from us (together, the “Services”).
PLEASE READ THESE TERMS CAREFULLY. SECTION 20 CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT HOW DISPUTES ARE RESOLVED. BY USING THE SITE, REQUESTING A QUOTE, PAYING A DEPOSIT, OR PURCHASING ANY PRODUCT OR SERVICE, YOU AGREE TO THESE TERMS. If you do not agree, do not use the Site or the Services.
1. Eligibility and Lawful Purchaser Certification
You must be at least 21 years of age to use the Site or purchase from us. By requesting a quote or placing an order, you represent and certify that:
- You are at least 21 years old and a resident of the United States
- You are not prohibited from receiving or possessing firearms under federal law, including 18 U.S.C. ยง 922(g) and (n), or under the laws of your state or locality
- You are the actual buyer of the firearm and are not acquiring it on behalf of another person. Purchasing a firearm for someone else who is prohibited from possessing one, or knowingly providing false information in connection with a firearm purchase, is a federal crime
- You will lawfully receive, possess, transport, store, and use any product you purchase from us
- All information you provide to us is true, accurate, and complete
We reserve the right to refuse, cancel, or decline to complete any sale, build, repair, or transfer, at any time and for any reason, including if we suspect that a purchase may be unlawful or that you have provided false information. We cooperate with law enforcement and may report suspected unlawful activity.
2. Compliance With Laws
Firearms laws vary by state, county, and city and change frequently. You are solely responsible for knowing and complying with all federal, state, and local laws that apply to the purchase, receipt, possession, transport, configuration, modification, and use of any product or service you obtain from us. Any shipping map, state list, or legal information on the Site is provided as a general convenience only, may not reflect recent changes or local restrictions, and is not legal advice. We may decline or cancel any order we believe cannot be lawfully completed, with any eligible refund handled under Section 8.
3. Quotes, Pricing, and Product Information
All prices on the Site, including “starting at” prices, are estimates and are not offers to sell. A quote becomes binding only when confirmed by us in writing and accepted by you, including payment of any required deposit. Unless stated otherwise, prices exclude shipping, insurance, FFL transfer fees, taxes, and any additional parts or labor identified during the work. We try to describe products accurately, but photos, descriptions, specifications, availability, and pricing may contain errors, may vary from the finished product, and may change without notice. We reserve the right to correct errors and to cancel any order affected by an error.
4. Deposits and Payment
Custom builds, competition builds, and Build Your Kit projects require a deposit of fifty percent (50%) of the quoted price before we order parts or begin work, with the remaining balance due in full before the rifle ships. Payment terms for in-stock rifles, repairs, and re-riveting will be stated in your quote. Deposits are non-transferable. Because parts are ordered and labor is performed to your specifications, deposits become non-refundable once parts have been ordered or work has begun, except as required by law. If a balance remains unpaid for thirty (30) days after we notify you that your rifle is complete, we may treat the order as abandoned, retain the deposit, and resell the rifle or parts to the extent permitted by law.
5. Customer-Supplied Kits, Parts, and Firearms
If you send us a parts kit, parts, or a firearm for building, repair, or re-riveting, you represent that you lawfully own the items and that they are legal to ship to us and to possess. We are not responsible for the condition, authenticity, or completeness of customer-supplied items. Surplus kits and used firearms often have wear, defects, or damage that may not be visible until work begins. We will notify you of any part that is unusable or any additional parts, 922(r) compliance parts, or labor required, and we will not proceed with additional charges without your approval. If you do not respond or approve within thirty (30) days, we may return the items to you at your expense, where lawful. Items left with us more than ninety (90) days after we notify you that they are ready for return or pickup may be considered abandoned and disposed of in accordance with applicable law.
6. Shipping, FFL Transfers, and Risk of Loss
New firearms are shipped only to a Federal Firearms Licensee (FFL) located in the purchaser’s state of residence, and the transfer is completed by that FFL, including any required background check. You are responsible for selecting a receiving FFL, confirming that it will accept the transfer, and paying any transfer fee. If your background check is denied or delayed, or the FFL refuses the transfer, return shipping, restocking, and related costs are your responsibility. Repaired or re-riveted firearms that you already lawfully own may be returned directly to you only where permitted by law. Title and risk of loss pass to you when the item is delivered to the carrier. Delivery dates are estimates only.
7. Build Times
Any build, repair, or delivery timeline we provide is an estimate and not a guarantee. Timelines may change due to parts availability, supplier delays, workload, shipping, regulatory changes, or other causes. Delays do not entitle you to cancel an order or obtain a refund of a deposit once work has begun, except as required by law.
8. Cancellations, Returns, and Refunds
All sales of firearms are final once the firearm has been shipped to your FFL. Due to federal and state laws governing firearm transfers, we do not accept returns of firearms for change of mind. Custom, competition, and kit builds are made to order and are not returnable. Requests to cancel before work begins will be reviewed case by case; any refund will be reduced by costs we have already incurred, including parts ordered and payment processing fees. If we cancel an order for any reason, we will refund any amount you paid for work not yet performed. Any warranty-related return must be authorized by us in advance and shipped in compliance with law.
9. Limited Workmanship Commitment
We stand behind our work. If you believe there is a defect in workmanship on a rifle we built or work we performed, contact us promptly and we will inspect the item and, at our option, repair the defect, replace the affected part, or refund the amount paid for the affected work. Any additional warranty terms will be stated in writing in your quote or invoice. This commitment does not cover normal wear, cosmetic wear, finish wear, misuse, abuse, neglect, accidents, improper maintenance or storage, use of improper, reloaded, or damaged ammunition, modifications or repairs by anyone other than us, or customer-supplied parts. This is your sole and exclusive remedy for workmanship issues.
10. Disclaimer of Warranties
EXCEPT AS EXPRESSLY STATED IN SECTION 9, THE SITE, THE SERVICES, AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
11. Firearm Safety and Assumption of Risk
Firearms are inherently dangerous and can cause serious injury or death. You agree to follow all safe firearm handling practices, to store firearms securely and out of reach of unauthorized persons and minors, to use only factory-new ammunition of the correct caliber in good condition, and to have any firearm inspected by a qualified gunsmith before use if you have any doubt about its condition. Any information on the Site or in our videos is for general informational purposes only and is not a substitute for proper training. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH THE HANDLING, MODIFICATION, AND USE OF FIREARMS, PARTS, AND AMMUNITION.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WYOMING APPLIED KINETICS OR ITS OWNERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE, THE SERVICES, OR ANY PRODUCT, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, THE SERVICES, OR ANY PRODUCT WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM. SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
13. Indemnification
You agree to defend, indemnify, and hold harmless Wyoming Applied Kinetics and its owners, employees, contractors, and agents from and against any claims, liabilities, damages, losses, fines, penalties, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to (a) your use, misuse, possession, transfer, modification, or storage of any product, (b) your violation of these Terms, (c) your violation of any law, including firearms laws, or (d) any false information you provide to us.
14. Export Restrictions
Firearms, parts, and related technical data may be subject to U.S. export control laws, including the Export Administration Regulations and the International Traffic in Arms Regulations. We do not sell or ship to locations outside the United States. You agree not to export, re-export, or transfer any product or technical information obtained from us in violation of these laws.
15. Discounts and Promotions
Discounts, including military, law enforcement, first responder, and Patreon member discounts, require verification of eligibility, apply only to the products and services we specify, cannot be combined with other offers unless we state otherwise, have no cash value, and may be modified or discontinued at any time without notice.
16. Acceptable Use of the Site
You agree not to use the Site to violate any law; submit false, misleading, or fraudulent information; impersonate any person; interfere with or disrupt the Site or its security; attempt to gain unauthorized access to any system; use bots, scrapers, or automated means to access the Site without our permission; or upload malicious code. We may suspend or block access to the Site for any violation.
17. Intellectual Property
The Site and all of its content, including text, photographs, videos, graphics, logos, trademarks, and the “Wyoming Applied Kinetics” name, are owned by or licensed to us and are protected by copyright, trademark, and other laws. You may view the Site for your personal, non-commercial use. You may not copy, reproduce, distribute, modify, or create derivative works from any content without our prior written permission. If you submit photos, reviews, or other content to us, you grant us a non-exclusive, royalty-free, perpetual license to use that content in connection with our business.
18. Third-Party Sites and Services
The Site may contain links to or embedded content from third parties, such as YouTube, Patreon, and Instagram. We do not control and are not responsible for third-party sites, content, products, or practices. Your use of them is at your own risk and subject to their terms and policies.
19. Electronic Communications
By using the Site or contacting us, you consent to receive communications from us electronically, including by email. You agree that all agreements, notices, quotes, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
20. Dispute Resolution, Binding Arbitration, and Class Action Waiver
Informal resolution. Before filing any claim, you agree to contact us and attempt to resolve the dispute informally for at least thirty (30) days.
Binding arbitration. Except as provided below, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, the Services, or any product, including the validity or scope of this arbitration provision, will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in the State of Wyoming or, at your option, by telephone or video conference. Judgment on the award may be entered in any court of competent jurisdiction.
Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive relief in court to protect intellectual property rights.
Class action and jury trial waiver. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. YOU AND WE EACH WAIVE THE RIGHT TO A TRIAL BY JURY.
Opt-out. You may opt out of this arbitration agreement by sending us written notice through our contact page within thirty (30) days after you first accept these Terms, stating your name and that you opt out of arbitration.
Time limit. To the extent permitted by law, any claim must be brought within one (1) year after the claim arises, or it is permanently barred.
21. Governing Law and Venue
These Terms are governed by the laws of the State of Wyoming and applicable federal law, without regard to conflict of law principles. Subject to Section 20, any action not subject to arbitration will be brought exclusively in the state or federal courts located in the State of Wyoming, and you consent to the personal jurisdiction of those courts.
22. Force Majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, severe weather, fire, pandemics, labor disputes, supplier or carrier failures, utility or internet outages, government actions, and changes in law or regulation.
23. General Terms
Entire agreement. These Terms, together with our Privacy Policy and any written quote or invoice we provide, are the entire agreement between you and us. If a quote or invoice conflicts with these Terms, the quote or invoice controls for that transaction.
Severability. If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in full effect.
No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms without our written consent. We may assign these Terms without restriction.
Survival. Provisions that by their nature should survive termination, including Sections 8 through 14 and 20 through 23, will survive.
Headings. Section headings are for convenience only and have no legal effect.
24. Changes to These Terms
We may update these Terms at any time by posting the revised version on this page and updating the “Last updated” date above. Changes apply to Site use and orders placed after they are posted. Your continued use of the Site or Services after changes are posted means you accept the updated Terms.
